The provisions of the Basic Law of some European countries, which envisage the right of a person to respect for private life are analyzed in the article. The article examines the norms of criminal procedure law of some European countries (Germany and Switzerland), which regulate the secrecy of communication. Besides, the grounds and conditions of the admissible restriction of a right to the secrecy of communication in criminal proceedings are examined.
